Terms & Conditions for Lodha Priva Maha Utsav

  1. The term of the Lodha Priva Maha Utsav offer is 1 st Feb 2017 to 31 st Mar 2017, both days inclusive & is only applicable to bookings made during Lodha Group’s launch Codename Central Park.
  2. All booked customers of Lodha group are eligible to be a part of this offer.
  3. The booked customer to give 4 or more number of referral bookings in Codename Central Park during the offer period will be eligible to get a trip to Mauritius. Lodha will pay in the form of vouchers worth INR 1,00,000.
    • Alternatively, customer also has an option of taking a cheque payout of INR 1,00,000. TDS will be deducted as per Government of India tax norms. Gift & all other relevant government taxes need to borne by the client.
  4. A booked customer to give 3 referral bookings in Codename Central Park during the period of the offer will be eligible to receive an iPhone. The cost of this reward is capped at INR 50,000.
    • Alternatively, customer also has an option of taking a cheque payout of INR 50,000. TDS will be deducted as per Government of India tax norms. Gift & all other relevant government taxes need to borne by the client.
  5. A booked customer to give 2 referral bookings in Codename Central Park during the period of the offer will be eligible to receive a smart watch. The cost of this smart watch is capped at INR 25,000 with all other applicable taxes inclusive.
    • Alternatively, customer also has an option of taking a cheque payout of INR 25,000. TDS will be deducted as per Government of India tax norms. . Gift & all other relevant government taxes need to be borne by the client.
  6. A source customer is eligible for benefits of a referral booking only on a confirmed referral booking at Codename Central Park.
    1. Winners under the above mentioned offers will be announced on 30 th April, 2017 & Lodha group will directly reach out to the winner. No public announcement of the name of the winners will be made by Lodha Group.
    2. Post confirmation of reward by the winner, rewards will be processed within a maximum of 60 working days. Lodha Group will not be responsible for delay caused by any third party.
  7. The referred customers need to clearly indicate Lodha Group’s (Customer Relationship Number) CRN of the source customer in their application form for the referral booking to be counted. Application forms of referrals without Source CRN will become ineligible.
  8. Lodha Group reserves the right to alter/change the terms of the offer partially or totally at any time during the term of the offer or any date later on.

Terms & Conditions for ‘50% more’ offer

  1. '50% more' offer is restricted to select "Lodha Priva event days only" and these are solely decided by Lodha Priva team. Currently Lodha Priva PVR Cinemas events in August 2016, Lodha Priva Dubai Meet & Elite meets In September 2016 are the events on which this contest will be applicable.
  2. All Lodha Group booked customers who attend these events of Lodha Priva are eligible to be a part of this offer.
  3. Booked customers (source customers) who give references on these event dates and in the event of bookings made by these references in Codename Golden Tomorrow, source customers will be given 50% more benefit on the base standard Lodha Priva payout of 60% of 1.4%. This implies they will be eligible to get 1.26% of unit/flat cost of referral booking amount instead of 0.84%.
  4. This amount will be credited to a customer’s Lodha Priva account 30 days after 19.9% payment receipt of their referral bookings post applicable Government of India tax norms.
  5. Points will be governed by terms of Lodha Priva program and can be redeemed at 1 point = 1 INR.

Terms & Conditions of Lodha Priva Programme

  1. Membership Agreement
  2. These terms and conditions set out the contractual relationship between Lodha Group (all companies in Annexure ‘A’) and each individual member of the Lodha Priva programme.

  3. Definitions:
  4. The definitions given here relate to the terms mentioned in the Lodha Priva programme, unless the context states or requires otherwise:

    • 2.1 The term ‘Lodha Group’ is used to collectively represent all the companies mentioned in Annexure A. The list of these companies may change over time.
    • 2.2 ‘Lodha Priva’ means the loyalty and rewards programme owned, managed and operated by Lodha Group offering benefits, facilities or arrangements to members by reason of their membership in the programme. For the avoidance of doubt, rights and obligations of Lodha Priva in these terms and conditions are rights and obligations of Lodha Group.
    • 2.3 ‘Lodha Customer’ is any entity or an individual who has bought in Lodha Group’s projects and still owns at least one of the properties brought directly with Lodha Group.
    • 2.4 Individual or entities who have visited Lodha Group’s sales offices and haven’t booked yet, registered tenants who have lived in Lodha Group’s projects for 3 or more months and Lodha Group’s employees (see point 4.2) are termed as ‘External Lodha Customer’.
    • 2.3 ‘Member’ means a member of the ‘Lodha Priva’ programme. All Lodha Customers and External Lodha Customers are eligible to be members of the ‘Lodha Priva’ programme.
    • 2.4 ‘Referral Reward’ means award given to a member for referring individual(s) or entity(s) to buy into Lodha Group’s projects. ‘Repurchase Reward’ means award given to a Lodha Customer for repurchasing into Lodha Group’s projects.
    • 2.5 Individual or entity to share the name and contact details of a reference is termed as ‘Source’ and the reference is termed as ‘Referral’ of the Source.
    • 2.6 ‘Consideration Value’ or ‘CV’ is the amount specified in the final agreement signed by and shared with the customer.
    • 2.7 ‘Launches’, ‘Pre-launches’, ‘Activations’ are any limited period windows (not exceeding 8 weeks from Start to End), where there is focussed sales activity (with or without ATL).
  5. General:
    • 3.1 Terms and Conditions of Lodha Priva programme are governed by the laws of the Republic of India and will be restricted to the Mumbai jurisdiction under the Mumbai High Court.
    • 3.2 Membership and benefits of Lodha Priva programme are offered at the sole discretion of Lodha Group.
  6. Membership:
    • 4.1 Membership is open to all individuals who are aged 18 years and above.
    • 4.2 Lodha Group’s employees excluding those from Sales, Sales Strategy, Marketing, Customer Care and Easy Lease departments are eligible to participate in Lodha Priva programme.
    • 4.3 Any change of information as provided in a) the application form for Lodha Customers b) site visit form for customers who have visited Lodha Group’s sales offices and haven’t booked c) registration form filled out by tenants must be raised as a request only through the individual’s account from online portal or app.
    • 4.4 The membership card of Lodha Priva programme is only valid for the period indicated on it. Should there be a change in member’s tier, the existing card will be no longer valid and a new card will be issued to the member.
    • 4.5 All communication will be mailed to the mailing address (postal or email) given to the Lodha Group at time of purchase or as updated from time to time and it is the responsibility of the member to raise a change request only through the individual’s account from online portal or app about any change in his/her address. All communication will be deemed to have been received by the member and Lodha Group bears no responsibility for communication not received or lost in the mail or courier.
    • 4.6 Lodha Priva has no predetermined termination date and may continue until such time as Lodha Group decides to terminate the programme, at any time, with or without notice to the members. Accumulation of points will cease immediately on termination of the programme. However, members will be given 12 months, from the date the programme termination is announced, to redeem a desired reward.
    • 4.7 Lodha Group reserves the right to add, modify, delete or otherwise change any of the rules, conditions, privileges, benefits, reward or reward levels pertaining to the programme at its sole discretion, with or without notice, even though changes may affect the value of points or rewards already accumulated.
    • 4.8 Membership to the Lodha Priva programme entitles members to earn points, which can be redeemed for rewards in accordance with the Terms and Conditions of the programme.
    • 4.9 Lodha Group reserves the right to grant or refuse membership to Lodha Priva programme.
    • 4.10 Lodha Group reserves the right to discontinue membership to Lodha Priva to any member who appears to be using the programme in a manner inconsistent with the terms and conditions, or intent of the programme, or any portion of the programme, including, but not limited to, reward redemption. Lodha Group also reserves the right to discontinue membership for any member who acts in a manner inconsistent with local or state laws, statutes or ordinances. Discontinued membership may result in the loss of all accumulated rewards and the cancellation of all Lodha Priva rewards, benefits and privileges.
    • 4.11 Rewards issued cannot be bartered or sold by members for cash at any point of time. These rewards may only be redeemed through options on offer through Lodha Priva programme. Any rewards which Lodha Group deems to have been transferred, sold or assigned in violation of the programme rules may be confiscated or cancelled.
    • 4.12 All interpretations of the Terms and Conditions and programme rules shall be at the sole discretion of Lodha Group.
    • 4.13 Each member is responsible for remaining knowledgeable about the programme rules and the rewards in his or her account. Lodha Group will send correspondence to members to advise them of matters of interest, including notification of programme changes. However, neither the Lodha Group nor programme management service providers will be liable for any failure to do so and will not be responsible for correspondence lost or delayed in the mail.
    • 4.14 Accrued rewards do not constitute property of the members. Accrued rewards are transferable in the event of death, as part of a domestic relations matter or otherwise by operation of law. In the event of death, Lodha Priva membership will be suspended and all accrued points transferred or cancelled.
    • 4.15 The programme and any benefit, offering, or rewards relating to the programme, shall not be construed as, or constitute a contract, or otherwise establish a contractual relationship between Lodha Group and Lodha Priva Members.
    • 4.16 Lost/misplaced membership cards will be replaced by deducting reward points from a member's account.
  7. Earning Rewards:
    • 5.1 Members can only earn rewards from the programme if they book in projects whose pre-launch/launch/activation start date is post the start date of Lodha Priva programme for that project. For example, if a member has booked in a project during a launch period and the programme start date is in between the launch, Lodha Priva programme benefits are not applicable for bookings in the launch. Only launches/activations that start after the start date of the programme are eligible for Lodha Priva rewards.
    • 5.2 Earning of rewards will be governed by the following table:

      % payout is calculated as a percentage of the flat cost. Bronze tier customers will only earn on referral bookings and not on their first purchase. All Lodha projects outside of India are exempted from this program.
    • 5.3 Rewards will be recorded if the customer’s membership number is quoted at the time of booking.
    • 5.4 Rewards earned by any individual member are not combinable with or transferable to other Lodha Group’s reward programmes administered in the past, present or future.
    • 5.5 All Lodha Priva members can check their reward update by logging into their account on website or app.
    • 5.6 Any fractional rewards earned will be rounded up or down to the nearest integer. For example, if a member earns 32525.25 points from a transaction, it will be calculated as 32525 points. If a member earns 32525.55 points from a transaction, it will be calculated as 32526 points.
    • 5.7 Tier entry, maintenance and upgrade are entirely determined by the following clauses:

      Platinum Customer referral/purchase/repurchase business to Lodha in the last 36 months reaches an amount more than Rs. 7 crore Customer’s referral/purchase/repurchase business to Lodha in the last 36 months is Rs. 7 cr or more. If lower, customer is changed to one level below.*

      A customer who has purchased for the first time, although does not earn any reward (except in case of a referral booking who will earn reward), would still become a member and enter a tier.

      *Lodha Luxury Collection customer’s tier will never be changed and will be a lifetime Platinum member.

      Scenarios: Few scenarios have been detailed as examples of how tier change and point accumulation will happen.

      Scenario 1: Customer makes a 6 cr. purchase on 1st Jan 2016. He does not re-buy or refer anyone for the next 3 years.

      • Enters Gold tier on 1st Jan, 2016
      • He is changed to Silver on 1st Jan, 2019

      Scenario 2: Customer makes a 6 cr. purchase on 1st Jan 2016. Buys a 0.6 cr. flat on 1st June 2018.

      • Enters Gold tier on 1st Jan, 2016
      • He is changed to Silver on 1st Jan, 2019

      Scenario 3: Customer makes a 6 cr. purchase on 1st Jan, 2016. Buys 4 units totaling 2.4 cr. on 1st June 2018 and does not make any purchase later.

      • Enters Gold tier on 1st Jan, 2016
      • Retains Gold tier through 1st Jan 2019
      • He is changed to Silver on 1st June, 2021

      Scenario 4: Customer makes a 6 cr. purchase on 1st Jan, 2016. Buys 4 units totaling 2.4 cr. on 1st June 2018. Buys one unit of 0.6 cr. on 1st June 2019.

      • Enters Gold tier on 1st Jan, 2016
      • He is changed to Silver on 1st June, 2021

      Scenario 5: Customer makes a 6 cr. purchase on 1st Jan, 2016. Buys 1 unit of Lodha Luxury project at 14 cr. on 1st June 2018. Does not make any other purchase/ provides any other reference booking.

      • Enters Gold tier on 1st Jan, 2016
      • He is upgraded to Platinum on 1st June, 2018
      • He is never changed

      Scenario 6: Customer buys a 0.6 cr. flat and enters Silver tier.

      • Inactivity will not change his tier.
    • 5.8 Lodha Group reserves the right to deduct points from a member’s account balance if the points have been erroneously recorded under the account.
    • 5.9 If a member believes rewards have not been credited for referral or repurchase booking, the member shall get in touch with Lodha Priva Member Care. In case rewards are accidentally missed out, the members must claim rewards within one year from the date of transaction.
    • 5.10 Promotions and special offers are at the sole discretion of Lodha Group. They can be withdrawn or altered without prior notice.
  8. Redeeming Rewards:
    • 6.1 All rewards earned can be redeemed only after 19.9% payment realization by Lodha group on the respective booking on which reward was earned.
    • 6.2 A blue tier member may encash the reward through way of a cheque payout after tax deductions as applicable. A request for the same has to be initiated by the member through his account on Lodha Priva website or app.
    • 6.3 All Silver, Gold and Platinum members can redeem their rewards through any one of the following options: a) Covering unpaid amounts of member’s existing property with Lodha b) Adjustment in CV of a repurchase booking for existing customers and adjustment in CV of a first time booking for referral customers (In this case, 19.9% payment realization is not valid) c) Against lifestyle benefits including travel in India and abroad among others d) Encashing after tax deductions as applicable
    • 6.4 Redemption process is initiated from the time a customer raises request and will take upto 8 weeks until reward is delivered to the member.
    • 6.5 In case of a cheque payout and for covering unpaid amounts of existing property with Lodha, TDS will be deducted as per Government of India tax norms.
    • 6.6 The reward payout shall be inclusive of Service Tax and all other applicable statutory levies. In no case shall the payout exceed 1.6% of flat cost for Platinum tier, 1.4% of flat cost for Gold tier, 1.2% of flat cost for Silver tier and 1% of flat cost for Bronze tier.
  9. Other Clauses:
    • 7.1 In order to be eligible for reward, the booking source shall be ‘Existing Lodha Customer’ for repurchase bookings and ‘Referred by Existing Lodha Customer’ with accurate Source customer details as required in Application form for referral bookings.
    • 7.2 The applicant name acceptable for repurchases are those of spouse, children, parents, parents-in-law, brothers and sisters, but would require documentary evidence.
    • 7.3 In case of cancellation of a booking, a member will move to Blue tier and continue to remain in that tier.
    • 7.4 Rewards earned on repurchase bookings will be forfeited in case of repurchase booking. However, for referral booking, rewards paid out after 19.9% payment will not be forfeited for Source customers.
    • 7.5 On successful credit of rewards, a member can redeem them anytime in the next 3 years post which these will expire.
